Question my m3 got rear ended, insurance won't pay for damge to engine bay.

they said its impossible because my car was crashed from rear end, my engine bay should take no damage at all, therefore its not cause by the accident. my engine cover and engine seal cap and other plastic parts have cracks, some of them were falling off from the main body.
Could someone understand how it happened tell me why this happened?
Maybe this could become useful on court,or they could listen to reasons.
Last photo showed a little dent on my hood.
It's a 50 year edition xdrive g80, almost brand new, i never launched it once, heart break.

Well technically if you were hit from the rear and the exhaust was hit, it would cause the engine to move forward and hit stuff if they are in the way, like that sway bar on the top of the engine

How hard were you hit? Looks like there's more damage than just in the rear.

That’s BS… my previous car G30 was rear ended and written off just because the exhaust was hit and it pushed the engine and broke the things… and it wasn’t even a hard hit

Yes yes, one of my exhaust bracket on the left is broke off from my car, barely hanging there. Could engine move vertically too? Because my hood got hit too.

Any decent lawyer can easily take care of this and put that insurance company to their knees.

On top of that , you got a concussion lol.

So I’d have the car written off as a total loss plus fuck them for everything they have and take their soul.

Get yourself a good lawyer and even better body shop who are willing to work together.

Don’t prepare
Should’ve had a lawyer from the moment you got rear ended and at the doctors office following Monday.

Lawyer needs to argue on your behalf with the insurance company regarding the engine bay damage and reach an agreement with the body shop that this is a total loss.

On top of that, if the impact was severe enough, I'd also expect the engine to swing a bit back and forward, following the impact.

It's not bolted in place, but held in by the engine mounts that have some give, so the force of the impact could have caused additional movement.

Huge thanks storm, now I have a clue of what's really going on in my engine bay.

I’m sorry, that car should be a total loss based on the pics and what you described.
Some of these insurance companies are jokers. Keep increasing rates, but when times for them to pay up, they bail.

Guys replying to OP, keep in mind that he shows his location as China so telling him to lawyer up may be a little different there.

OP, best of luck with this. Yes, definitely possible for the engine to move vertically if the exhaust were hit hard enough. And judging by that collision beam that looks more like a croissant than a beam, I'd say you got whacked pretty hard.
