It's more of what didn't happen.

F31 went through the processes unique to FMVSS.

MB sells the C-Class Estate in Canada, but it is impossible to obtain a Certificate of Conformity for the US.

SUV are a bit different because the same tests are required for all markets.

There is a small market for Premium High Performance Station Wagons in the US. It's less than 500 per year and shrinking fast. MB has never sold more than 125 E63 Estate per year and the avg is less than 75. This year to date is 51 so far + 12 cancelled orders (13 listed but I bought one and have already traded it). Audi was planning on 125 RS6 per year for 2 years. That program is on the edge of falling apart.

BMW isn't who needs convincing. It's the current US Government that's standing in the way. There's two Hail Mary's that could make it possible, but both have to occur and no later than January.

All X3,X4,X5,X6,X7 have a battery in the trunk... I don't believe this story...

It's a Battery, a damn Battery...lol

BMW is selling electric and hybrid vehicles in the US with a much bigger battery...


Well, I'm not supriced since FMVSS and DOT they have weird regulations, however if BMW want to they could bring the wagon to US.


So just out of curiosity, where is the battery on the RS5 Sportback or E63S Wagon?



Edit: A lot Mercedes Wagons have their Battery in the trunk same as BMW.

Ultimately it is about the money. BMW doesn't think it can cover the compliance and potential re-engineering costs in trying to harmonize wagons for sale in the US, and looking at the market and numbers, I don't blame them.

The best way to do this is to convince Congress to allow cars that meet UNECE regulations to be imported to the US without any additional compliance with FMVSS.

Canada already accepts the UNECE standards as alternatives to the CMVSS (Canada's version of the FMVSS), and the M3 wagon can be imported there without additional certification.

As long as we get it in Canada i'll be happy. But as usual BMW don't give a shit about the Canadian market.

Under FMVSS it's a potential high mass, blunt projectile located inside the occupant safety compartment.

It's not that the battery cannot be located there, it's that FMVSS requires 7 additional crash tests beyond the 2 common per UN. These are not cheap (approx $2m each). Then you'll have to do DOT glass, rear lighting, license plate bracket, etc etc.

Slant hatchback Vehicles are typically designed so that the luggage compartment doesn't technically become part of the occupant safety cell.

E63S has the main non-propulsion accessory battery under the front cowl. There is a small auxiliary battery for Auto-Start Stop in the back, but it is considered inconsequential under the regs.
