Everyone is so fed up with bmw and the dealerships shenanigans that when they see someone else getting screwed (again) it pisses them off.

Once you make a decision on which direction you are taking with your car make sure you put this dealership on blast. Even, if for some reason, they come threw the fact that they tried that bullshit is unforgivable

I was browsing Porsche, Mercedes' and Audi forums and it doesn't seem like those guys are going through the same or even close amount of bs as us.

What can be done to avoid this type of situation? All I have is a build sheet that shows MSRP. Should I be asking for a purchase agreement before the car gets here?

This is what I got from my dealer in addition to the build sheet. Still, this doesn't guarantee anything.

I also have a similar sheet from Porsche, but that one came with the MSRP crossed out with pen and a note that reads "MSRP subject to change".

Not much really, we're at the whim of the dealers. In some cases, legal action (or the threat of) can work, but if they decide to go after more money, not much the consumer can do.

Once you sign your purchase agreement your payments will start. My dealer said they could only do this once they had a VIN. So, that's an option, but this could mean that you'd start making payments months before you get your car (given the current situation).

Also, this only accelerates the conversation. If they want to shaft you they still can and will. You'll just know sooner.

You are correct. That came with the build sheet. Two separate documents, I know. Nevertheless, I've bought cars from this person many times and we "trust each other". I bought my first car from him when he was the Internet Sales person, and now he is the Director of New and Pre-Owned Car sales. Also, it's widely known that this dealer in my area behaves different to the rest. He was upfront with me from day one saying "I can't give you a discount, but we also won't charge you above MSRP".

I'll post here when my deal is completed and let you all now how it went.

I think in your case you have a valid reason to want to see the purchase agreement ahead of taking the trip there. I'd ask if I were you. You're now close enough to delivery and can tell them that you need to see the contract before you buy your plane ticket (whether you're buying a plane ticket or not is irrelevant).

But to wait months for an allocation / building / shipping for an agreed upon price only to at the very last second throw a 10k markup is about as low as it gets in the car salesman game. I almost look forward to blasting them at this point.

Talk to a lawyer. You have a written document from them. I think you have a case.

Yeah I've been in port since 1/9! I've been in contact with bmw usa. I left a tweet/message for bmw. They got ahold of me and said they are looking in to it and apologize for the inconvenience. But she said they brought it up in a morning meeting and will get back to me Monday!
