Sorry to hear that. Looks like they were finding a reason to take the build from you and give it to someone who was offering them more money.

People here want to lawyer up for each and everything, it might not be worth your time and effort. Even if you do that, not sure what the outcome would be. I would at least talk to people higher up in the dealership chain and express my dissatisfaction before moving on to the next dealership. Once you get your money back, do post reviews in public forums about your experience.

My thoughts exactly....it does seem they were looking for an excuse to steal my allocation from me. And no I will not lawyer up over this, unless they don't give my deposit back. They sunk this deal, not me.

After thinking about this last night, I think I will mention this to BMWNA to at least report the matter and see what they have to say. The response I receive from them will dictate if I ever purchase another BMW in the future. If this is how a repeat customer is treated (this would have been the third BMW we have purchased from this dealership), I will simply look at different manufacturers for my next vehicle.

If you had a purchase agreement you could try to go to that states' AG to see if they can help you get your car. I had to go through the Mississippi AG to force a dealer to give me my deposit on an order back

So I just got off the phone with a rep from BMWNA, and things went as I expected unfortunately.

The rep basically said she would submit the formal complaint against the dealership, complaints are reviewed internally, the dealership has every right to cancel the order, BMWNA is not involved in the sales practices of independently owned dealerships, and that there would be no follow up from BMWNA regarding this matter.

So my friends, that is that I guess. I'll keep an eye open for my deposit refund to show up on my card, and I will officially move on from any BMW purchases in the future.

Sorry about this. Have you reached out to the owner yet? I think its worth a shot given that you have put in so much time into this. Given that u r a repeat customer, the owner might be your best bet. The BMWNA really doesnt have much to do here with the way US dealerships are set up.

I find the whole thing bizarre. It can't be difficult to add features and my sales associate has been great about this. You're adding additional sales, so surely it's worth their 5 minutes to boost MSRP by $900.

My family used to own a boat dealership and I know that we told customers to go pound sand on more than one occasion, but it was usually something like a lawyer rejecting our contract and bringing in some multiple page document that they cooked up and expecting us to change our policies. GTFO with something like that. But this... crazy.

Thank you, but at this point after first being insulted then having my allocation stolen from me, I'd rather put a lit cigarette out in my eye than do business with this dealership again.

I would recommend you at least talk with the Sales Manager to see if the CA might have acted on their own. Give them a chance to see if they rectify and if not then part ways. That allocation could possibly get reverted back to you if it hasn't changed status.

Trust me I'm in a similar situation and wouldn't have felt good if I hadn't tried escalating within the dealership.

I forgot to mention, the rep at BMWNA seem surprised at first when I gave her my production number....she said that vehicle is under a different name & configuration, and that it's currently "in production as of today".



Which got me thinking, do dealerships actually have the power to hold an allocation in 112? If so, this debacle is definitely looking like it was planned all along.

If this is the case, I could have been used just as a mule for an allocation....

I don't think they can hold it in 112...but I think it's possible they could have a way to discuss with BMW employees in Germany to see how close it is to moving to 150. If they have a good relationship with someone over there they may have had a heads up and said nope this one is close. Or, they were just using your order to get an allocation they otherwise wouldn't have gotten.

OP - Sorry this happened to you. It is terrible. It sounds so strange and weird. The comment you posted from BMWNA that the order "that vehicle is under a different name & configuration, and that it's currently "in production as of today" was really strange. Sounds like someone at the dealership hasn't been telling you the truth during the whole process.

This is reminding me that the local dealer that I dislike recently had an M3 Comp deal "fall through" and despite having a line, one of the sales associates bought it. It seemed pretty shady because the vehicle never hit the market. I asked the dude that bought it if I could get a ride, as I'm basically ordering a vehicle I've never driven or ridden in. He said no because he doesn't want to put any miles on it. One of the other sales guys said something about getting through break-in and he dismissed that, saying it wouldn't matter. I interpreted this to mean he's going to flip it. Same guy already has an X3 or X5 M as well as an older car that I believe is an M3.

I have to wonder if something shady happened to make that order fall through. The dealership is closest to me but I won't do business there due to past experiences.

This is God awful. Real sorry this happened to you OP. It's disheartening to hear of shady business practices like this, but the only thing we can do as consumers is to put places like this on blast. Social media, review sites, etc.

Thinking pragmatically, it’s best practice to treat the humans at these dealerships with kid gloves when they’re leaving $10-15k on the table selling to you for MSRP. I wouldn’t let the convo devolve and give them any sort of reason to back out.

Don’t expect better from Porsche or Mercedes or even Audi at this time.

I can second that, was left with sour taste at the Porsche dealership that had my deposit for close to 2 years. Crazy times.

Sorry to hear about your troubling experience OP. Cancelling your order because you wanted to make a change to your build before it even hit production is egregious. I must've made at least 5-6 changes to my build before it locked and my CA never had an issue or made any fuss about it. As others have stated, it sounds like the dealership was looking for any and every excuse to flip your allocation over to someone else. Scum bag move for sure.
