I use a service that costs $75 + court fees to file small claims anywhere in the country with a 10-15 minute time investment to type up the details of my concern. They do all the research and serve the defendant and submit the claim so that the other side pays all the fees in the end. That reduced the friction of taking someone to court to practically zero. It's been an effective way to get folks to do the right thing.
Yeah he's told me BS from the get go.
Appreciate your advice regarding a third party handling it. I'm in Scotland but I'll do some research if required to find out if a similar service exists over here.
You've actually hit on the real issue. It's not so much the physical damage to the car, it's wether or not the drama kicks off.
I just can't be bothered with that and I'd happily pay a professional service to take the lead. I'm not good in dealing with people who've shown me disrespect and tried to BS me.

Thanks. I don't plan on being out of pocket unless it has to go down the long legal route.
I'd look for a service as suggested earlier where a third party service takes the lead initially.

class actions are where there are a large number of plaintiffs who jointly sue the defendant. doesn't seem like that's the case here. this would be a standard small claims suit assuming the damage is below 5k GBP (small claims limit in Scotland).

Just found the pictures from 2018 when this same issue happened to my new F82 individual.
Maybe those who don't think it's a big deal might understand why I'm venting now it's happened to the car that replaced it.
Same as today. When I was driving home I could see the rubber seal was all over the place, removed the door panel and found all sorts of issues.

Thankfully after one bad experience regarding my bike and poor service I took it upon myself to get the tools needed and now service it myself, it's actually part of the reason I built the garage the way I did. To have a bike workshop at the back with natural light coming in.
The reply's to this thread have been great, such an amazing community when you have a car problem on your hands.

I'll gauge his reaction to the costs once I present them to him, but I'll not hesitate to go the legal route if I get any delay or further BS.
It's going to be costly that I know, but he must have been aware it was all going south quickly. He's pushed way past the point of justifying it as a legitimate error and he's only himself to blame.
If the install had been completed professionally and maybe he'd unluckily damaged something by accident then fine, shit happens, you own up and you talk to the customer. But no, he throws everything back together and even accepts the part payment I gave out of goodwill knowing he's done some real damage. All I can see now is him bashing the door/window seal with his hand to try and seat it properly when I was waiting outside looking in.

Like trying to put the toothpaste back in the tube…..
Man, that is absolutely brutal.

I was not that happy with my tints and had them redo them (specs of dust Could be seen easily) but atleast there was no damage!

How do you get in to the tint business and have absolutely no idea what you are doing? Is his main business something else and this is just a side service that he doesn't sell much of?

I can't imagine this guy is going to have the cash or the spine to pay up the thousands of pounds it's going to take to put that right…he sounds like a right shit bag!

It's a real shame that these people exist, the inherent liability if you don't know what you're doing is huge financially. I mean apart from your home your car is the biggest purchase you normally make.

Maybe it is a front and he's playing tint guy on the side, I don't know for sure but would is be a surprise. No.

Thanks for everyones comments, this is a great community and source of information when you encounter problems and want to discuss your feelings.
Got to say the posts have helped me greatly, It is a first world problem but we all love our cars and it's the only place I can discuss it with like minded people.

Todays update: Spoke to BMW, the door card is £1322.00 plus VAT @20%, waiting on a price for the door seal but this is a complex part so i would expect £200+. The car has to go in to the dealer for an inspection to determine the scope of work but I'd imagine all in £2500 would be a reasonable guess at the expected cost in the end.
Just back from a meeting with the Tint installer, I made it clear how upset and angry I am even though I'm not showing it.
He has provisionally agreed to cover the cost, we will see. At 50 years old I'll reserve judgment on his character for now until he puts his money where his mouth is.
I also let him know the car has been a lifetimes work to achieve, how it's a very special thing to me and how I look after all the things I own with great care.
These things are me rewarding myself, I don't ever explain myself to anyone but given the context I felt he should get it into his head where I'm at.

This is why I don't subscribe to the carefree "it's just a car" attitude some have around 3rd parties who damage personal property. For some, these cars represent a lot of invested time, money, and effort. A strong defense is completely understandable and reasonable.

It shouldn't matter if its a $500k car or a fkn $5 hot wheels. If someone hires you to do a job, you do it correctly or you face the consequences. I understand making a mistake here and there. It happens to everyone. However, what I see in the photos is the result of sheer laziness, or complete lack of knowledge. In this case, he should close up shop.

Thanks. I've learned that walking away initially and digesting the situation works best or me. Because if I'm pissed off in the moment and get attitude from someone in the wrong it can get out of hand.
My car is a huge deal to me, more emotionally but the financial part is significant also.

Your 100% correct, sheer laziness, or complete lack of knowledge. It's either one, or both.
In my business (Custom Installation of audio video systems) we are in homes taking them apart, running cables and putting things back together. Thankfully I've had only a couple of things happen that were genuine accidents. I've always approached it with an attitude of fixing the problem and then discussing what happened later. What I can't get my head round is people like him who think the problem/damage is just going to leave when the customer drives away.
Hopefully he stands up and accepts the financial penalty for not taking pride in his craft.
