Engine coming out for oil leak *Final Update: Lemon Buyback, couldn't stop leak*

Final Update: They attempted to fix the oil leaking from the rear main numerous times including pulling the engine, tearing it apart, changing the rear main, etc. Nothing worked after at least 5 attempts of different things and months in and out of the shop. It's likely a block defect. They agreed to do a buyback on it and so I traded the 2023 for a new 2024 with very similar specs.

This is in my 2023 X3M Comp but since it has the S58 and this forum has more users with an S58 I wanted to post here.

Is the S58 known to have any oil leak problem?

I brought my 2023 F97 into service for the break in service with 1,007 miles on it. They called me and told me there's an oil leak at the back of the engine at the "timing cover" (I think the SA was mistaken on what to call it). Because of where the leak is they recommended not driving it and having them fix it before I pick it back up. No problem for me.

They tell me that they need to pull the engine/tranny to fix it and before that they'll need to put some dye in the engine to isolate where it is coming from. They said that BMW wants to be involved in it as well.

I sure hope it doesn't take long. I'm pretty bummed but at least it's under warranty and the tech brought it up to the SA since I never even saw it.

I would guess it's an isolated case and not a chronic issue with the S58, as I haven't heard of any oil leak issues here that required an engine drop.
Any series production engine can have a faulty assembly.
Hopefully yours can be resolved soon!

Sorry for taking such a long time to reply to this. I FINALLY had an opportunity to bring the vehicle back.

Initially they ended up wiping the oil off without doing anything because the tech thought that maybe the oil was just some residual that the person that assembled the motor wiped his finger off on or something. He drove it after wiping it off and nothing leaked for the few miles he drove it. They wanted to make sure it was an actual leak and not just something like that.

Well, I bring it back today so they can take a look and work on some other weird harmonic vibration I get right at 2k rpms and sure enough it is a leak of some sort. They're going to have to pull the tranny and get BMW engineers involved they said to see what's going on with it. Not a big update but it is at least something and I'll have answers soon.

Update: It appears to be a rear main seal leak. They're going to drop the pan and replace the rear main seal. I guess it's just bad luck but at least we have answers now.

Will this be an even exchange or you have to pay more money on top?

Basically they are paying me out for the 2023 and then I had to buy another and there are only 2024s now.

But, I知 getting a great deal on the 2024 and they took very little depreciation on the 2023. so overall I知 probably coming out slightly ahead actually. Especially when it comes time to sell it and I have a one year newer car with 10k less miles.

Sounds like they're offering you a buyback in lieu of going through the Lemon Law process. Most states they're required to pay out the actual purchase price of your car. If you're ok with taking a hit that's fine, but it sounds like you can get a little more out of it, but might be a longer process.
