Eh, I would try to keep name quiet too, unless really necessary. This thread is already shedding good light upon the fact that some dealers will try to mark these as non-refundable

By signing the document, you might have to go through a lot of hassle to get the money back. Hope you can resolve it by escalating to their management as they dont have an allocation and you turned around within 24 hours.

Based upon contract you have to wait until they can't deliver a custom ordered 23 M3. Once that is no longer an option the contract is void as no such delivery will exist. Noting nothings been sold.

However with that note that price is locked as per the agreement so..... Something you could be like nah you kept my deposit iron clad and agreed to XYB if a 24 sees an increase.

Nothing states they won't have an order as builds drop monthly and randomly. So you have 90 days ish before it flips to 24s.

Also since the contract isn't completed if you don't buy anything they have to at some point give it back noting the last line.

Best option is to wait it out 3 months and see what happens, unless you find something now.

Then don't say anything and let time expire.

The question is what is your position for a build date?

Like others have said, it sounds like you're just going to have to ride it out until the MY24's go into production, which would make this null and void. There are only a few months left in the MY23 production cycle, so the likelihood of them actually delivering a car that meets that contract is slim based on what you've said.

Lol dispute it. Call your CC not for “purchase protection” but for the the dealer not delivering what you paid for. Tell the CC the money was for a car purchase and they don’t have the car, they haven’t shipped anything to you and you would like to dispute it on the basis of failure to deliver the item you purchased. Not advice…Just an old man spouting nonsense

Like it was mentioned earlier you cannot receive a 0 mile car so this contract is void if it has more than 0. I'd bring it up to a lawyer and ask their opinion then you can tell them this contract is invalid refund my money.

Yes, this. Initiate a chargeback. They are not delivering on their end of the bargain.

Pretty shady, I would definitely call my bank to back charge.
At the same time, I would never sign a paper saying non-refundable.

I personally think the "dealer list" is complete BS.

I have been on a list with my local dealer, supposedly 1st, since December.
They never bothered to call me once. I guess they never get allocations at all.

And at the same time, I called a few other dealers and have been told the same excuse "sorry we have 20 people on the list already".... and out of the blue, one of these dealers (who refused to put me on their "list") called me one day to offer me am allocation for which the customer canceled. I guess 20 people didn't pick-up their phone or responded to texts, emails.. when the dealer tried to contact them.
My car is now in transit on a boat.

You just have to keep calling around.

I called Amex and said that the dealer doesn’t have the car and that I was told the deposit was refundable. I didn’t go through purchase protection, it was a chargeback.

BMW corporate does not have any say on dealership policies. If they really cared for customers, they would have cracked down ADM long time ago.
