I think you still don’t get it. The F8x trunk is completely separate from the passenger compartment. That’s why the location is irrelevant as far as the US rules are concerned.

G81 most likely has the battery on the right side, covered by panel on the side of the trunk, same as the sedan. I’m guessing it may be considered part of the passenger compartment since the X3’s location under the panel in the middle of the floor seems to be fine for US homologation.
