You could definitely pay to get them swapped out with no long term issue... just cost of parts and labor. In your spot if I was dead set I would probably go with an upgraded m performance part.

In the example where the car came in wrong the dealer was definitely doing avoidance, if I had to bet it was less so for the labor (I can't imagine painting them would be that fewer hours) and more so the warranty quagmire it would leave the car in with a different part number brakes that were installed by the dealer that don't match what the car is supposed to have. It's different if the change is consumer driven modification vs the dealer doing it to right a "wrong" but the car is still technically modified
