True, and to continue to be fair, I'm not sure Max ever got a penalty for not leaving room before.

He did not get a penalty in Brazil.
HAM didn't get a penalty either.

The penalty is really a black and white flag, which Max got for swerving, as we know, you're only allowed one move to block.
