From page 33 of the 2006 BMW E90 Warranty booklet:
This warranty shall be null and void if the
vehicle identification number has been
altered or cannot be read, if the odometer
has been replaced or altered and the true
mileage cannot be determined, if the
vehicle has been declared a total loss or
sold for salvage purposes, or
if the vehicle has been used in any competitive event.

A manual transmission can be set to "comfort", "sport", and "track" modes simply by the technique and speed at which you shift it; it doesn't need "modes", modes are for manumatics that try to behave like a real 3-pedal manual transmission. If you can money-shift it, it's a manual transmission. "Yeah, but NO ONE puts an automatic trans shift knob on a manual transmission."
