One is an archaic amendment, that was written over 200 years ago, before day modern-day law enforcement and advancement in firepower was envisions but was never revised to match contemporary society, due to politics.
The other is a modern interpretation of US automotive safety standards, in which bucket doesn't meet, due to the fact that they are typically in a fixed position and lack heigh adjustments, so they can't be placed parallel to the side-impact airbags. The ROW doesn't require side-impact airbags, so they can get any seat they like..
